What is New York’s No Fault Divorce Law?
New York no-fault divorce law is a brand new law that allows you to get divorced because your marriage has “irretrievably” broken down for six months.
Specifically Domestic Relations Law (DRL) § 170 (7), the new law that has allowed for no-fault divorce, states: “The relationship between Husband and Wife has broken down irretrievably for a period of at least six months, provided that one party has so stated under oath.”
You used to have to prove fault grounds in order for a New York court to grant you a divorce. The fault grounds were some pretty ugly accusations of adultery, abandonment, refusal of sexual relations for over a year or cruel and inhuman treatment. You no longer have to put your spouse or yourself through this ugly process.
New York has finally woken up to the fact that if you want out of your marriage you deserve to get out.
You will still need to meet the residency requirements to file for divorce in New York, but are free to get a no-fault divorce without proving these ugly allegations.
